James Keown, 31, is accused of slowly poisoning his wife to death with an ingredient found in anti-freeze.
Tomorrow, a radio host from Missouri is due in a Massachusetts courtroom to face murder charges.
But Keown's lawyer says the charges can't be proved.
Keown left Jefferson City, Missouri and is en route to Massachusetts to face a murder charge. A Middlesex County grand jury in Cambridge indicted him last week.
Arrested at the radio station where he worked, Keown is accused in the poisoning death of his wife, Julie, when he spiked her Gatorade with anti-freeze.
The 31-year old registered nurse died September 2004 while the couple lived in Waltham.
Prosecutors say Keown killed his wife with ethylene glycol, a susbstance found in anti-freeze.
"No evidence that they've told us they have connects Mr. Keown with the death of his wife," said Attorney Adam A. Kretowicz.
Kretowicz was retained by Keown after the investigation began more than a year ago. He says Keown has and continues to cooperate with authorities.
"He spoke with the police detectives for hours," said Kretowicz. "He then allowed them to search their home for hours and take a load of evidence with them or what they thought was evidence."
In a news conference, Middlesex District Attorney Martha Coakley said, "Keown killed his wife to collect a quarter million dollar life insurance policy.
Coakley said Keown kept some things hidden from her.
Attorneys on both sides agree it's a tough case, built on circumstantial evidence. He'll face the charge tomorrow.
