Victim's Family Files Suit In Carnival Death

WORCESTER (CBS4) ― The family of a Shrewsbury man who died after being thrown from a carnival ride in 2004 has filed a wrongful death suit.

38-year-old Andrew Fohlin was killed in September of 2004 when a "Sizzler" carnival ride he was on, flew apart at a church fair. The lap bar on the ride failed when two bolts popped off.

The suit was filed against the company that owned the ride, the company's president, carnival supervisor and insurance company, and a private inspector who signed off on the device.

The carnival maintenance manager pleaded guilty to involuntary manslaughter charges earlier this year and was sentenced to 2 1/2 years probation.

Since Fohlin's death, the state's public safety department has revised its regulations. It now requires that up-to-date safety certification stickers be prominently displayed on all carnival rides.
