SJC: Alimony Doesn't End At Retirement

BOSTON (AP) ― The state's highest court says alimony payments don't automatically end when someone reaches retirement age.

The ruling from the Supreme Judicial Court came in a divorce case involving a former Massachusetts judge.

The justices on Monday upheld a decision reducing the alimony payments made by Rudolph Pierce, a former federal magistrate and state Superior Court judge.

After Pierce retired from private law practice at age 65, a probate judge cut his annual alimony payment from $110,000 to $42,000, but Pierce asked for alimony to be eliminated.

The SJC on Monday rejected that request, partly because Pierce's ex-wife had lost her job.

The court said retirement is only one factor to be considered when deciding whether to modify alimony payments.
