Elderly Driver In Wal-Mart Crash Goes To Court

The elderly driver who crashed his car through the front of a Wal-Mart in Danvers last June made his first court appearance on a negligence charge today and was ordered by Judge Richard Mori not to drive while the case is pending.
Alaina Hayes, 25, one of the crash victims, attended his arraignment. She says her daughter, Makayla Hayes, now 19-months old, is still being treated for head injuries from the crash when Vesprini's Toyota Camry suddenly
smashed through the Wal-Mart. "I remember the car coming at us. I tried to get out of the way. I had no chance to get out of the way and, from there, it was me on the floor screaming for her," she recalled.

Police say Vesprini told them at the scene "he was mad" about the handicapped spaces being full and must have stepped on the gas instead of the brake. He was released after a not guilty plea was entered. His license was revoked after the crash because he was considered him an immediate threat to public safety.
Alaina Hayes, has retained personal injury attorney Barry Feinstein who has named Vesprini and Wal-Mart as defendants. "(Makayla's)...undergoing developmental counseling and developmental testing because of some of the brain issues that are involved," he told reporters.
Makayla bears scars above her left eye and under her chin from the crash which her mom says also broke her jaw and caused brain swelling. "We just have to watch her. She's got a speech therapist that comes out. She's got a physical therapist that's going to be coming out and working with her. It's just day-by-day."
As Vesprini waits for his next court appearance, December 3, Makayla is waiting for her next scheduled surgery, her third.
He and his attorney had no comment.
The maximum sentence for the charge Vesprini could face is two years in jail but law enforcement officials doubt he'll do any time because of his age.
