The half brother of comedian Dane Cook pleaded not guilty to embezzling millions from the comedian on Wednesday.
Darryl McCauley of Wilmington was arraigned at Woburn District Court on Wednesday and was ordered held on $3 million bail. He was charged with larceny and forgery. Judge Joseph Jennings ordered McCauley to document the source of any funds used to meet his bail.
Prosecutors say the 43-year-old
McCauley stole millions from Cook while being paid $12,500 a month to act as Cook's business manager as part of the comedian's company, Great Dane Enterprises, Inc.
Cook's attorney, Joseph Zwicker, described Cook as "very distraught" about the situation.
McCauley's attorney, Robert Goldstein, said his client is innocent.
Prosecutors say McCauley transferred funds from Cook's business accounts to his personal accounts between July 2007 and December 2008. In one instance, investigators said McCauley forged a $3 million check from Cook's account to himself. He is accused of cashing that check three weeks ago.
Prosecutors allege McCauley stole about $10 million from Cook in all. Authorities say they were alerted to the alleged embezzlement by Cook's attorney.
McCauley allegedly used the money to buy four cars, and to take a seven-day trip across the country, during which he rented various cars.
Cook suspected his brother was stealing from him for some time, prosecutors said. He recently hired a new business manager in California and had been pressuring McCauley to hand over documents.
In addition to searching and removing evidence from McCauley's Wilmington home, police also searched his condo on the coast of Maine where they found a safe inside a wall. Prosecutors said they recovered $800,000 cash from inside the safe. They are still searching for the rest of the money, they say.
Prosecutors allege McCauley took a train cross-country and stashed millions of dollars in various safe deposit boxes. Police are trying to track down all of that money.
The 36-year-old Cook's comedy album, "Retaliation," went double platinum and he has appeared in several films, including "My Best Friend's Girl" with Kate Hudson.
