Turnpike Authority: Major Highways Could Close
Court Hearing Thursday Could Lead To Restraining Order
BOSTON (WBZ) ―
A hearing could close down parts of major roads in and around Boston. A judge heard arguments on whether toll money can continue to be used to pay off the Big Dig. One possible outcome the judge could issue a restraining order.
The judge took the case under advisement and is expected to make a decision, possibly on Friday.
The Turnpike Authority warns that parts of the Pike may have to close if a restraining order is issued. Portions of the Mass Pike inside the I-95 belt, segments of the Big Dig and the Boston Harbor Tunnels may be closed down, the board said.
Thursday's court hearing is part of a class action lawsuit brought by more than 2,000 toll payers. They argue tolls collected on the Pike are an illegal tax because the money is used to pay for the Big Dig's roads and its debt, not just maintenance on the Pike.
On Wednesday the plaintiffs released a study they funded which found only 46 percent of drivers who use the Big Dig, harbor tunnels and the Pike east of I-95 actually pay tolls.
Thursday a Superior Court judge heard arguments over a request for a restraining order that would stop the turnpike from using toll money for the Big Dig. The Turnpike Authority is warning that if that order is granted, parts of these major roads in Boston and the surrounding area, will have to shut down.
