A clerk magistrate has issued indecent assault charges against state Sen. James Marzilli in a case the district attorney previously had declined to prosecute.
A criminal complaint charges Marzilli with two counts of indecent assault and battery in an incident involving an Arlington woman.
Middlesex District Attorney Gerry Leone said in May he would not file charges against Marzilli because there wasn't enough evidence to prove the woman's claim that he groped her on April 6.
The woman's lawyer said the clerk-magistrate issued the complaint after the woman swore her story was true during a closed-door hearing in Cambridge District Court. Neither Marzilli nor his lawyer attended the hearing.
Leone's office is prosecuting Marzilli in a string of alleged assaults involving four women in Lowell on June 3.
