DA: No Charges Filed In Fatal W. Roxbury Fire

Firefighters Paul Cahill and Warren Payne were killed battling a fire inside the Tai Ho restaurant.

The district attorney has just announced he has finished his investigation into the West Roxbury fire that killed two firefighters last August. Daniel Conley determined that no criminal charges will be filed.

In his statement, Conley says he found no evidence that any crime was committed as to how the fire started.
The DA also says he will release the entire investigation to the fire department and its board of inquiry that includes the autopsy and toxicology reports on Cahill and Payne.
Those reports indicated the firefighters had alcohol and cocaine in their systems when they died.
Lat month, the board of inquiry released a report on the fire that didn't include those reports because the board never asked for them.
Fire Commissioner Roderick J. Fraser finally requested the reports last week, but he was told he had to wait until the DA investigation was completed.
Boston Mayor Tom Menino wants all firefighters randomly tested for drugs and alcohol. That's now part of the negotiations with the union for a new contract.
