Delaware officials are suing the U.S. Army Corps of Engineers over its plan to deepen the Delaware River shipping channel without obtaining state permits.
The Corps wants to deepen the channel by five feet from Philadelphia to the mouth of the Delaware Bay, a move supporters say will accommodate larger ships and keep local ports competitive.
Opponents say the dredging will stir up toxic sediments and harm water quality while benefiting only a few refineries.
Delaware, which recently denied the Corps' request for a permit application, filed the lawsuit Friday after the Corps said it has the authority to maintain navigation if a state fails to grant a timely permit.
New Jersey also has indicated that it may sue to force the Corps to obtain permits.
