Report: Moss Will Request Delay In Hearing

Read The Entire Affidavit

BOSTON (WBZ) ― Wide receiver Randy Moss won't be going to court in Florida next week, while the Patriots prepare for the Super Bowl in Arizona, according to a published report.

Moss's attorney Richard Sharpstein told ESPN he will represent Moss in Broward County Circuit Court on Monday and request a delay in a scheduled hearing to determine whether a permanent restraining order should be issued against Moss.

The hearing was set for Monday in Fort Lauderdale, after Rachelle Washington, a friend of Moss for the last 11 years, obtained a temporary restraining order against him.

In court documents, she claims Moss committed "battery ... causing serious injury" to her at her home Jan. 6.

No criminal charges have been filed against Moss. He was not required to be at Monday's hearing.

"I'm going to go in and ask the judge to put it off," Sharpstein told ESPN.com. "We'll agree to extend the temporary order until we can deal with a permanent order, and we'll ask to put it off until a date after the Super Bowl. The judge will set a hearing [date] and Randy will appear. Then we'll deal with the substance, which is bulls---."

Moss said the allegations are false and Washington made the claim to extort a six-figure settlement from him.

According to the affidavit obtained by WBZ, Washington claims she's been in an "intimate relationship" with Moss since 1997.

Washington's attorney claims Moss offered money first.
